Criminal Defense

DUI/DUII: Driving Under the Influence of intoxicants is one of the most common criminal allegations defended by the Harlan Law Firm. According to the law in the State of Oregon and Washington, it is unlawful for any person to drive while their ability to drive is appreciably affected by alcohol or while their blood alcohol level is in excess of .08. DUI is a crime that cuts across all social and economic barriers. We have defended doctors, lawyers, stockbrokers, and housewives accused of DUI.

Driving Under the Influence is a serious crime. The maximum sentence is up to a year in jail and fine of $5,000.00 or $6,250.00 depending on whether the offense occurred on Washington or Oregon. In addition to a criminal sanction, each state may administratively suspend a person's driving privileges for as little as 90 days and as long as 2 years.

Through the years, we have successfully defended dozens of people accused of driving under the influence. Although a serious offense, it is a crime that can be defended and is a crime that carries a punishment that can be managed.

DOMESTIC VIOLENCE: Is a designation of an offense that occurs between 'family or household' members. More specifically, it means that the actors involved in a criminal offense are spouses, former spouses, persons who have a child in common, adult persons related by blood or marriage, adult persons who reside or who have resided together, or persons that have a dating relationship. Domestic violence offenses are common. Similar to DUIs, domestic violence cuts across all social and economic barriers. If a person is convicted of a domestic violence offense, they lose their right to own or possess a firearm indefinitely. DRUG OFFENSES: Felony drug offenses take many forms: Possession of a Controlled Substance, Possession of a Controlled Substance With Intent to Deliver, Manufacturing a Controlled Substance. If the substance is a nominal amount of marijuana, the crime may be classified as a misdemeanor or even a civil infraction. On the flip side of the coin, a person convicted of Possession With Intent to Deliver, Delivery, or Manufacture of a Controlled Substance may be looking at a lengthy prison term. A successful defense of a criminal drug offense is commonly focused upon the constitutionality of the search and seizure by the government.

Citizens are protected from unreasonable searches and seizures conducted by the government by the Fourth Amendment of the United States Constitution, Article 1, & 7 of the Washington State Constitution, and/or Article 1, & 9 of the Oregon State Constitution. As a general rule, when a police officer or other government official searches a person or place where a person has a reasonable expectation of privacy, the police officer must either have a search warrant, or the police officer must be acting consistently with an applicable exception to the warrant requirement. Absent a search warrant or an applicable exception to the warrant requirement, a search is unconstitutional. The remedy for an unconstitutional search or seizure is exclusion of evidence, which commonly includes the illegal controlled substance itself. Dismissal of the criminal allegation is the common result of if the evidence upon which the criminal allegation is suppressed.
