An overwhelming majority of DUI allegations involve breath tests. A breath test is an indirect measure of the alcohol in the lungs via lower lung air. Blood cases can be much more difficult to defend because the test results purport to represent the amount of alcohol in the blood. A large portion of persons charged with DUI find that the most harmful aspect of the case is potentially losing their ability to drive. Anytime a person refuses to provide a breath sample or gives a breath test that is over a .08 BAC, the Department of Licensing will presumptively suspend that person's license. This is a totally separate action from the case the government will bring against you, and it only concerns the licensing aspect of the case. Fighting the DOL's action may provide an opportunity to do serious damage to the government's case, and it might just preserve your ability to drive. read more
